Criminal Injuries Compensation Assault Claims by RAM Legal Services
If you've been injured either physically or mentally as a result of an assault you may be entitled to claim compensation through the Criminal Injuries Compensation Authority (CICA) Scheme. You are eligible to make a claim if you reported the incident to the police within 48 hours or as soon as was reasonably possible. You must also have been seen to assist the police in their investigations by making statements where necessary and providing evidence where necessary. You will not be able to make a claim if you refused to make a statement or to press charges. Sexual assault claims If you have been the victim of a single sexual assault you may be entitled to compensation under the Criminal Injuries Compensation Scheme . We understand that this can be a sensitive subject and we will deal with your claim discreetly. You may also choose between a male or female representative to deal with your claim. You can still claim for sexual assault if there are no physical injuries. What if the offender was not caught? As long as you assisted the police in their investigations you can still claim if the offender was not caught. How is my award calculated? Your award will be based on medical notes about your injury. The award its self will be calculated using a guideline system that is based on a strict tariff of injuries that have been set by the Criminal Injuries Compensation Authority. What if my claim is rejected? If the Criminal Injuries Compensation Authority decide that you are not eligible for an award we will look at appealing their decision. Where relevant we will form an appeal paper to challenge the CICA's decision using our wealth of experience in winning these cases. If the CICA still decide not to award you compensation for your injuries we can take your case to a tribunal and form further appeals and arguments in your favour.
