Criminal Injuries Compensation Abuse Claims by RAM Legal Services If you have been subjected to a period of physical, mental or sexual abuse you may be entitled to compensation under the Criminal Injuries Compensation Scheme . We understand that this can be a sensitive subject and we will deal with your claim discreetly. You may also choose between a male or female representative to deal with your claim. You can still claim for sexual abuse if there are no physical injuries. There are no restrictions on receiving compensation if the person who abused you was a member of your family or you were living together at the time of the abuse. Reporting the incident to the police Due to the nature of these claims there is no time limit for reporting the abuse to the police. It is important however that the incident is reported before you submit a claim for compensation through the Criminal Injuries Compensation authority. It is also important that the police evidence that relates to your case is still available for the Criminal Injuries Compensation Authority to review. Time Limits You are expected to submit a claim within 2 years of the last period of abuse unless you were unable to do so due to your injuries. This time limit does not apply if somebody was abused as a child as they can still make a claim as an adult and have up to two years after their eighteenth birthday to make a claim provided that the police evidence is still available. Claims for abuse on behalf of children You can apply for compensation on behalf of a person who is under the age of 18 if you have parental responsibility for that person. If the person has been abused by a member of the same immediate family you may still be able to claim without parental responsibility. What if the offender was not convicted? As long as you assisted the police in their investigations you may still be eligible for compensation if the offender was not convicted. What if I have a criminal record? Under the new Criminal Injuries Compensation Scheme 2012 you are not eligible for an award if you have any unspent convictions. The CICA will perform a Criminal Records Bureau check on each applicant before making an offer of compensation. How is my award calculated? Your award will be based on medical notes about your injury. The award its self will be calculated using a guideline system that is based on a strict tariff of injuries that have been set by the Criminal Injuries Compensation Authority.
